The Trump administration recently issued an Executive Order (EO) addressing state-level artificial intelligence (AI) laws. The EO seeks to establish a national policy framework by preempting state regulations. It directs the attorney general to form an AI Litigation Task Force to challenge state laws that conflict with the EO’s policy and could limit state funding.
Congress has constitutional authority to preempt state laws. However, states retain the right to regulate many areas of health care under the Constitution and through federal statutes.
Pennsylvania Attorney General Dave Sunday as well as other attorney generals are pushing back regarding this executive order. Legal challenges are expected. PAMED will continue to monitor developments and provide updates to members.
