Acting Secretary of Health Alison Beam Issues First Amendment to Order Regarding Vaccine Providers
This order will in essence require providers who have received first dose allocation vaccines in at least the past two weeks prior to March 16, 2021, to make every effort to schedule appointments for eligible individuals in Phase 1A who request an appointment, including individuals not in the providers’ current patient networks.

The U.S. Department of Health and Human Services Office for Civil Rights previously issued a Notice of Proposed Rulemaking that if finalized would modify several key portions of the HIPAA Privacy Rule. The comment period was recently extended until May 6, 2021.

CMS Revises Repayment Terms for Advanced Payment Program – Repayments Will Now Begin After One Year
The Centers for Medicare and Medicaid Services (CMS) has revised the repayment terms of its Advanced Payment Program (APP). Previously, repayment was set to begin 120 days after the advance payment was issued to the provider. Repayments will now begin one year after the advance payment was issued to the provider, which could be as early as April 2021.

Waivers Issued Regarding Retired Physician and Medical Student Administration of COVID-19 Vaccines, Volunteer Licensee Practice Sites Also Expanded
On Feb. 5, 2021, the Pennsylvania Department of State and Gov. Wolf issued regulatory waivers enabling certain retired physicians and medical students to assist with COVID-19 vaccination efforts. PAMED continued to advocate for its members and sought clarification, which we received on Feb. 12, regarding the waiver relative to retired physicians, including whether they apply to only retired physicians or also to physicians who hold an active-retired license and whether medical malpractice insurance is required.
