Understanding Philadelphia City Pandemic Ordinances Requiring Certain Benefits for Health Care Employees
Last year, the Philadelphia City Council amended provisions of the Philadelphia Code to require that certain health care employees are compensated in the event they contract a communicable disease during a pandemic or epidemic event, all under certain terms and conditions.

Quality Payment Program 2019 Performance Preview Available
The Doctors and Clinicians Preview Period opened Jan. 25, 2021, allowing eligible clinicians to preview Quality Payment Program (QPP) performance data for 2019. Clinicians can access the preview through the QPP site before it becomes publicly available.

Medicare Advanced APM Participation Updated by 2020 Law
The Consolidated Appropriations Act, signed into law on Dec. 27, 2020, included an extensive number of provisions aiming to ease burdens as the country continues to struggle amid the COVID-19 pandemic. One of the directives included in the legislation freezes the minimum thresholds for qualifying participation in Advanced Alternative Payment Models (Advanced APMs) in the Quality Payment Program.

Pa. Dentistry Board Regulations Allow Dental Hygienists to Practice in Specified Physician Offices
Final-form regulations by the State Board of Dentistry expanding the practice sites of public health dental hygiene practitioner (PHDHPs) to include certain physician offices were published in the Jan.16, 2021 edition of the Pennsylvania Bulletin. These regulations took effect immediately upon publication.

Pa. Supreme Court Holds That Physicians Cannot Be Held Liable under the Mental Health Procedures Act for Harm Caused by Mentally ill Patient
On Dec. 22, 2020, in a 6-1 decision, the Pa. Supreme Court ruled that a lawsuit against the doctors who did not take steps to involuntarily commit a man who killed one person and injured others in a March 2012 shooting at Western Psychiatric Institute and Clinic cannot go forward.

PAMED Joins with the AMA to File Amicus Brief in Peer Review Case
PAMED and the AMA filed an amicus brief arguing that if this decision were allowed to stand, peer review activities would be severely hampered and practitioners would be hesitant to partake in such activity for fear of their information being used in a lawsuit.

2020 House of Delegates Update
In light of the ongoing impact of COVID-19, the Pennsylvania Medical Society’s Board of Trustees made the difficult decision to cancel the face-to-face meeting of the 2020 House of Delegates in Hershey. Plans for an alternative remote meeting format are tentatively targeted for the same weekend of October 24-25, 2020.
