Harrisburg, Pa. June 30, 2021 – As a result of the Pennsylvania Medical Society’s (PAMED) strong advocacy on behalf of the state’s physicians and patients, we were successful in getting informed consent legislation across the finish line today as it was signed into law by the Governor and immediately takes effect.
This legislation (Senate Bill 425) addresses the state’s 2017 Supreme Court’s decision that ruled that physicians have a non-delegable duty to obtain a patient’s informed consent. Under this new law, physicians will be able to delegate the task of obtaining a patient’s informed consent to another qualified practitioner such as another physician colleague.
On behalf of PAMED’s Board of Trustees, Board Chair Edward Balaban, DO, enthusiastically thanks the Governor and the legislature, especially Sen. John Gordner who introduced the bill, for their continued leadership and support on this issue.
