Superior Court Issues Decision in Medical Liability Venue Case
On Feb. 22, 2021, the Pennsylvania Superior Court issued a decision in the case of Dockery v. Thomas Jefferson University Hospitals, Inc., et al. upholding the trial court’s order to transfer a medical professional liability case out of Philadelphia County and thereby also upholding the existing venue rule and statute for medical professional liability actions.

Waivers Issued Regarding Retired Physician and Medical Student Administration of COVID-19 Vaccines, Volunteer Licensee Practice Sites Also Expanded
On Feb. 5, 2021, the Pennsylvania Department of State and Gov. Wolf issued regulatory waivers enabling certain retired physicians and medical students to assist with COVID-19 vaccination efforts. PAMED continued to advocate for its members and sought clarification, which we received on Feb. 12, regarding the waiver relative to retired physicians, including whether they apply to only retired physicians or also to physicians who hold an active-retired license and whether medical malpractice insurance is required.

Medicare Advanced APM Participation Updated by 2020 Law
The Consolidated Appropriations Act, signed into law on Dec. 27, 2020, included an extensive number of provisions aiming to ease burdens as the country continues to struggle amid the COVID-19 pandemic. One of the directives included in the legislation freezes the minimum thresholds for qualifying participation in Advanced Alternative Payment Models (Advanced APMs) in the Quality Payment Program.
