Generally speaking, if your practice is a solely-owned practice or partnership that was created without filing a document with the PA Department of State you would not be required to file. Entities such as LLCs, S-corporations and C-corporations do file documents with the state to be created/recognized so they would need to file unless they qualify for an exemption as listed via the link to the BOI website. As counsel for PAMED, I cannot provide legal advice to individual members. I am speaking generally about the legal requirement. You should consult with your attorney as to whether you will need to file. Please note, that the federal requirement is currently on hold. But there is a new state requirement for filing that is detailed in this week's The Dose that owners should review.

    Thank you,

If your practice name is in the above, you must file.

Therefore, my small ophtthalmology practice does not qualify to report any information. Is that correct? Harold P. Koller, M.D.
