Physicians No Longer Considered Creditors under Red Flags Rule

On Dec. 18, 2010, the President signed into law Senate Bill 3987, the "Red Flag Program Clarification Act of 2010," which clarifies that physicians are no longer considered creditors under the red flags rule.

This legislation, which was passed by the US House of Representatives and US Senate in early December, limits the type of “creditor” that must comply with the red flags rule.

According to senators who spoke in favor of the legislation, its purpose is to clarify that physicians should no longer be classified as “creditors” for the purposes of the red flags rule.
 
Although physicians are not required to comply with the red flags rule, the Pennsylvania Medical Society offers informational resources to practices who wish to be alert to identity theft.
